BamChi Provider Terms of Service
These terms govern the relationship between BamChi and service providers ("you") using the platform. By registering as a provider, you agree to these terms.
1. Introduction
BamChi is operated by Bamchi Pty Ltd (ABN 54 689 357 917). The platform connects pet owners with independent pet service providers across Australia. BamChi acts as a marketplace facilitator — we do not provide pet services directly.
2. Eligibility
To register as a provider on BamChi, you must:
- Be at least 18 years of age
- Be legally entitled to work in Australia
- Hold any relevant licences, qualifications, or registrations required for your service category (e.g. veterinary registration for vet services)
- Have appropriate insurance coverage for your services (public liability insurance is strongly recommended)
- Provide accurate and truthful information in your application
3. Account and Profile
You are responsible for maintaining the accuracy of your profile information, including your business name, service descriptions, pricing, availability, and qualifications. BamChi reserves the right to review, approve, suspend, or remove provider profiles at its discretion. All provider applications are subject to an approval process before your listing becomes visible to pet owners.
4. Service Listings
As a provider, you set your own prices, descriptions, and availability. All service descriptions must be accurate and not misleading. BamChi may moderate, edit, or remove listings that violate these terms or our community guidelines. You must not list services that are illegal, dangerous to animals, or that you are not qualified to provide.
5. Bookings and Cancellations
Once you confirm a booking, you are expected to honour it. If you need to cancel:
- Provider cancellation: Cancel as early as possible. Repeated cancellations may result in profile penalties, reduced visibility, or suspension.
- No-show policy: Failure to attend a confirmed booking without notice may result in a strike on your account. Three strikes may lead to account suspension.
- Client cancellation: Cancellation policies are set by BamChi. You will be notified of any cancellations and compensated according to the applicable cancellation policy.
6. Payments
BamChi facilitates all payments through Stripe. Key payment terms:
- Platform fee: BamChi charges a 10% service fee on each completed booking, deducted from the booking amount before payout.
- Payouts: Processed weekly to your linked bank account via Stripe Connect. You are responsible for setting up and maintaining your Stripe account.
- Refunds: In the event of a client dispute or refund, BamChi may deduct the refunded amount from your future payouts.
- Taxes: You are responsible for your own tax obligations, including GST registration and reporting. BamChi does not withhold tax on your behalf.
7. Provider Conduct
As a BamChi provider, you agree to:
- Conduct yourself professionally at all times when interacting with clients and their pets
- Prioritise animal welfare above all else — never engage in practices that could harm an animal
- Report any injuries, incidents, or concerns to both the pet owner and BamChi immediately
- Not solicit clients to transact off-platform to avoid BamChi fees
- Comply with all applicable Australian laws and regulations relating to your services
- Maintain any required licences, permits, or registrations throughout your time on the platform
8. Insurance and Liability
You are an independent service provider, not an employee or agent of BamChi. You are responsible for obtaining and maintaining appropriate insurance for your services, including public liability insurance. BamChi acts solely as a marketplace facilitator and accepts no liability for the services you provide, any injuries to animals or persons, or any property damage that occurs during your services. You agree to indemnify BamChi against any claims arising from your provision of services.
9. Reviews and Ratings
Clients may leave reviews and ratings after completed bookings. You may respond to reviews publicly. BamChi may remove reviews that are fraudulent, defamatory, or violate our guidelines. You must not incentivise, manipulate, or fabricate reviews.
10. Intellectual Property
BamChi owns all intellectual property in the platform, including the BamChi name, logo, and technology. By creating a provider profile, you grant BamChi a non-exclusive, royalty-free licence to use your business name, profile content, and photos for the purpose of operating and marketing the platform.
11. Termination
Either party may terminate this agreement at any time. BamChi may suspend or terminate your account immediately for breach of these terms. Upon termination:
- Any pending bookings should be honoured or cancelled with appropriate notice
- Final payouts for completed services will be processed within 14 days
- Your profile will be removed from the platform
- You must cease using any BamChi branding or materials
12. Privacy
Your personal information is handled in accordance with the BamChi Privacy Policy and the Australian Privacy Act 1988. By registering as a provider, you consent to the collection, use, and disclosure of your personal information as described in our Privacy Policy.
13. Dispute Resolution
If a dispute arises between you and a client, we encourage direct resolution first. If that fails, BamChi may mediate at its discretion. For disputes between you and BamChi, these terms are governed by the laws of Victoria, Australia, and the parties submit to the jurisdiction of the courts of Victoria.
14. Changes to These Terms
BamChi may update these terms from time to time. We will provide at least 30 days notice of material changes via email or through the platform. Continued use of the platform after changes take effect constitutes acceptance of the updated terms.
