Shop seller terms

These are the terms between BamChi Pty Ltd and every business that sells products through BamChi Shop. You agreed to them when you applied to open a shop. They are written to be read, not skimmed: each section says what actually happens, in the order it happens. Where they use a legal term, it is because the law does.

In plain words

This summary is here to help. It is not the agreement; the numbered sections below are.

  • You sell your own products to BamChi's pet owners. The sale is between you and the buyer. BamChi runs the marketplace, takes the payment and passes your share on.
  • You pay 12% commission on each item sold, and nothing else. No listing fees, no monthly fees. Founding sellers who applied by 25 September 2026 pay 5% for their first three months.
  • Every listing is looked at by a person before it goes live. You photograph your own products, describe them honestly and price them in Australian dollars with GST included.
  • You post within the days you told us, with tracking, to anywhere in Australia you said you deliver.
  • Faulty items are always returnable. Change-of-mind returns follow your policy, which can be more generous than our minimum but never less. Personalised and perishable items are exempt from change of mind.
  • Some things can never be sold here: live animals, prescription-only veterinary medicines, electric shock and prong collars, recalled, counterfeit or stolen goods, and anything claiming to treat, cure or prevent disease.
  • You are paid through Stripe, to your own bank account. BamChi may hold a payment while a buyer problem is being sorted out.
  • Either of us can end this. You finish your open orders; we pay you what you are owed.

1. Who we are and who these terms bind

BamChi, we and us mean BamChi Pty Ltd (ABN 54 689 357 917), of Melbourne, Victoria. You and the seller mean the business that applied for a shop, and the person who applied on its behalf. If you applied for a company, partnership or trust, you confirm you have authority to bind it, and that entity is the seller.

BamChi Shop (the Shop) is the product marketplace inside the BamChi app and on bamchi.com. The seller portal is sell.bamchi.com, where you manage your shop. A buyer is a BamChi user who orders from you. An order is one checkout by one buyer from your shop, however many items it holds.

These terms apply from the moment you tick the box on the application and for as long as you have a shop, plus any period afterwards in which an order, return, payout or dispute is still open. The BamChi Terms of use and Privacy policy continue to apply to you as a BamChi user. Where they and these terms say different things about selling, these terms win.

2. Opening a shop

Application. You apply once, through the seller portal. A person at BamChi reads every application and replies, normally within one business day. We decide who sells on BamChi and we may decline an application without giving a legal reason, though we will always tell you the practical one. A declined applicant may apply again once the reason is addressed.

What you tell us must be true. Your trading name, legal name, ABN if you have one, GST status, contact details, what you intend to sell and where you post from must be accurate when you give them and kept accurate afterwards. If you told us you are not registered for GST and later register, you must update your shop before your next sale.

Who can sell. You must be at least 18, based in Australia, and entitled to sell the products you list. An ABN is not required, but if you are carrying on an enterprise you are responsible for knowing whether the law requires you to hold one. You are responsible for your own tax affairs, including income tax and GST.

One shop per business. Each business has one shop. If you run several distinct brands, ask us before opening more than one; we may allow it where the brands are genuinely separate.

Existing BamChi providers. If you already offer services on BamChi, your shop is a separate thing with its own application, its own terms (these) and its own commission. Nothing here changes your provider agreement.

3. Your account and your shop page

You are responsible for everything done through your seller login. Keep the password private, use a strong one, and tell us immediately at [email protected] if you think someone else has it. Anyone you give access to acts as you.

Your shop name, logo, banner and story must be yours to use and must not impersonate another business, suggest an affiliation with BamChi beyond selling here, or mislead buyers about who you are or where you are. We may ask you to change any of them, and may change your shop's web address (slug) if it collides with something we need.

Your shop is visible to buyers only after we have approved the application, you have completed the setup steps the portal shows you, and we have set the shop live. Until then, buyers cannot find you and nothing is for sale.

4. What can be sold, and what can never be sold

BamChi Shop is for pet products: things a pet owner buys for their animal or for looking after it. Listings that fall outside that are removed.

Never, in any form, under any description:

  • Live animals of any kind, including eggs, larvae and live feeder animals.
  • Prescription-only veterinary medicines (Schedule 4 and Schedule 8), and any product that requires a veterinarian's authority to supply.
  • Electric shock collars, prong (pinch) collars, and any device designed to correct an animal by pain or electric stimulation, whether or not it is legal in your state.
  • Recalled, counterfeit, stolen or grey-import goods, and goods that infringe someone else's trade mark, copyright or design.
  • Anything claiming to treat, cure or prevent disease, or otherwise making a therapeutic claim, unless it is a registered or listed therapeutic good or an APVMA-registered veterinary chemical product and the claim is exactly the approved one.
  • Human medicines, tobacco, vaping products, alcohol, weapons, and products made from protected wildlife (including ivory, fur and skins from species listed under the EPBC Act or CITES).
  • Products intended for illegal activities, including dog-fighting equipment and anything designed to evade breed or animal-welfare laws.
  • Digital goods, services, gift cards, raffles and anything that is not a physical product delivered to the buyer.

Allowed with care. These are welcome but are reviewed more closely and must meet the conditions stated:

  • Food, treats and chews: labelled with ingredients, net weight, storage instructions, a best-before date where relevant, and your business name and contact. Products should meet the Australian Standard for the manufacturing and marketing of pet food (AS 5812) where it applies. Raw and fresh products must be sold with clear handling and cold-chain instructions, and you must be able to deliver them safely.
  • Supplements and wellbeing products: no claim that the product treats, cures, prevents or diagnoses any condition. "Supports", "for everyday wellbeing" and similar general statements are acceptable; "for arthritis", "anti-anxiety" and "cures" are not.
  • Over-the-counter parasite and grooming treatments: only if APVMA-registered (the registration number appears on the pack) and sold in original, unopened packaging.
  • Electrical and battery products: must comply with the Australian electrical safety and EMC requirements that apply to them (including the RCM mark where required) and carry a plug suitable for Australia.
  • Toys and chews: honestly described for the size and chewing strength of the animal they suit, with choking and supervision warnings where appropriate.
  • Second-hand goods: only where the listing says clearly that the item is used and describes its condition accurately.

We update this list as the law and the marketplace change. The version on this page is the one that applies. A listing that breaks these rules is removed; a shop that keeps breaking them is closed.

5. Listings

Accuracy. Every listing must describe the actual product a buyer will receive: what it is, what it is made of, its size, weight or quantity, which animals it suits, and anything a reasonable buyer would want to know before paying. Nothing may be described as Australian-made, organic, handmade, vet-approved or similar unless it is, and unless you can show it.

Photos. Photos must be your own, of the product you are selling, and at least three per listing. No stock images, no manufacturer images unless you are the manufacturer, no photos of a different colour or model. Photos may not contain text overlays, watermarks other than your own logo, or contact details.

Variants. Where a product comes in sizes, colours or flavours, list them as variants of one product, each with its own price and stock, rather than as separate listings.

Price. Prices are in Australian dollars and include GST if you are registered for it. The price you set is the price the buyer pays for the item; postage is shown separately under section 8. You may not set a price on BamChi that is higher than the price you charge for the same item elsewhere in order to recover the commission.

Stock. A listing shown as available must be available. Set stock levels honestly and keep them current. Made-to-order items must say so, with the making time included in your dispatch estimate.

No steering. Listings, photos, shop pages and messages may not contain your website, phone number, social media handles, or any invitation to buy the same thing somewhere else. Your own logo on your own packaging is fine.

Your rights in the content. You keep ownership of your photos and words. You give BamChi a worldwide, royalty-free licence to use, reproduce, adapt and display them, in the app, on bamchi.com, in search results, in BamChi's own emails and marketing, and in the launch email to BamChi users, for as long as your shop exists and for a reasonable period after so that order records remain complete. You warrant that you have every right needed to grant that licence.

6. Review

A person at BamChi looks at every listing before it goes live, and again when you make a significant change to it. We normally reply within one business day. We may approve it, send it back with a note naming the exact thing to fix, or decline it. You can fix and resubmit as many times as you need.

Approval means the listing met our rules on the day we read it. It is not a certification of the product, its safety or its legality, and it does not transfer any of your responsibilities to us. We may remove a live listing at any time if it turns out to break these terms or the law, if a buyer raises a safety concern we consider credible, or if a rights holder makes a complaint we consider credible.

7. Orders

The contract of sale is between you and the buyer. BamChi is the marketplace, not the seller. We collect the buyer's payment on your behalf as your limited payment collection agent, and paying BamChi discharges the buyer's debt to you.

Accepting orders. An order placed for an available listing is accepted the moment the buyer's payment succeeds. You cannot decline it because you would rather not sell to that buyer. You may cancel only where the item is genuinely unavailable, the buyer's address cannot be delivered to, or you reasonably suspect fraud, and you must do so within one business day with the reason recorded in the portal. Cancelled orders are refunded to the buyer in full by BamChi and count against your shop.

Dispatch. You post every order within your stated handling time, counted in business days from the order, and on the posting days you told us. If something delays you, you tell the buyer through BamChi before the handling time runs out. Consistently late dispatch is grounds for suspension under section 15.

Tracking. Every parcel is sent with tracking and the tracking number is entered in the portal on dispatch. Untracked postage is not permitted, because without it neither of us can resolve a "never arrived".

Packaging. Items arrive in the condition a buyer would expect. Fragile items are protected; food is sealed; anything perishable is packed to stay safe for the delivery time you have chosen. Packaging must not carry marketing that steers the buyer off BamChi.

Records. You keep your own records of each order for at least seven years, as the tax law requires, and BamChi keeps its own.

8. Postage and delivery

You set your postage: one flat rate, rates by weight, or free postage, plus an optional "free postage over" threshold. Postage charges are shown to the buyer before they pay and are passed to you in full; BamChi does not take commission on postage.

You post anywhere in Australia unless your shop settings exclude particular states or territories, and those exclusions are shown to buyers before checkout. You may not decline an order because of where in your stated area it is going.

Risk in the goods passes to the buyer on delivery. Until then, a parcel that is lost or damaged in transit is your responsibility: you replace it or refund it, and you pursue the carrier. We recommend cover for parcels above the value you are prepared to lose.

Deliveries outside Australia are not offered through BamChi Shop.

9. Prices, GST and tax

All amounts in the Shop are in Australian dollars. If you are registered for GST, your prices include it, you account for it on your own activity statement, and you are responsible for the GST on every sale you make. If you are not registered, your prices contain no GST and you must not describe them as including it.

BamChi issues the buyer an order confirmation and receipt on your behalf showing the seller, the items, postage and the total paid. Where you are registered for GST, that receipt is a tax invoice issued by BamChi as your agent under the ATO's agency rules, and you agree to that arrangement. You remain responsible for the accuracy of your GST status in the portal.

BamChi's commission (section 10) is a taxable supply by BamChi to you. BamChi issues you a tax invoice for it. Where the law allows, you agree that BamChi may issue recipient-created tax invoices for any amount you are entitled to from BamChi.

You are responsible for any other tax, levy or duty arising from your sales.

10. Fees

Commission. BamChi charges commission on each item sold: 12% of the item price the buyer pays (GST inclusive where applicable), excluding postage. Commission is deducted from the payment before it is passed to you. Payment processing costs are included in the commission; there is no separate processing fee.

No other fees. There is no listing fee, no monthly fee, no fee to join and no fee to leave.

Founding rate. Sellers whose application was submitted by 11:59 pm on 25 September 2026 (Melbourne time) pay commission at 5% instead of 12% for the three months starting on the day their application was submitted, whatever day their shop actually went live. From the day after that period ends, the standard rate applies to new orders. The founding rate is personal to the shop and cannot be transferred, extended or paused.

Refunds and commission. When an order is refunded to the buyer in full, the commission on it is refunded to you in full. When an order is partly refunded, commission is recalculated on the amount the buyer finally paid. Commission is not refunded on orders refunded because of your cancellation under section 7 or your breach of these terms.

Changes. We may change the commission rate or introduce other fees with at least 30 days' written notice by email to the address on your account. A change never applies to orders placed before it takes effect, and never shortens a founding-rate period already running.

What BamChi does with the commission. It pays for payment processing, the app, the marketplace, review, buyer support and BamChi's marketing of the Shop to its users.

11. Getting paid

Stripe. Payouts are made through Stripe, our payment partner, to a bank account in your business's name. You must complete Stripe's onboarding, including the identity and business verification the law requires Stripe to do, before any payout can be made. Stripe's own Connected Account Agreement applies to that account.

When. Your share of an order becomes payable when the parcel is marked delivered by the carrier's tracking, or seven days after you marked it dispatched, whichever comes first, provided the buyer has not raised a problem. Payable amounts are paid out on Stripe's standard schedule for Australian accounts, normally within a few business days.

Holds. We may hold all or part of a payment where a buyer has reported a problem with the order, a chargeback or payment dispute has been raised, we reasonably suspect fraud or a breach of these terms, or the law requires it. A held amount is paid, refunded to the buyer, or applied as section 13 describes, once the matter is resolved. We tell you when we hold and why.

Negative balances. Where a refund, chargeback or adjustment leaves you owing BamChi more than the payments waiting for you, you agree that we may deduct the difference from your next payouts, and if none follow within 30 days, that you will pay it within 14 days of our invoice.

Payout setup before launch. Until payouts are switched on for the Shop, the portal shows the payout step as "not yet available". No order can be placed with any seller until payouts are available to all sellers, so nothing is ever owed to you that cannot be paid.

12. Returns, refunds and the consumer law

The Australian Consumer Law applies to your sales. Buyers have guarantees that cannot be excluded: that goods are of acceptable quality, fit for any purpose you told them about, match their description and the photos, and arrive within a reasonable time. Where a product fails one of these guarantees the buyer is entitled to a repair, replacement or refund, and for a major failure to choose a refund. Nothing in these terms, or in your own returns policy, limits those rights, and your policy may not say otherwise.

Faulty, damaged or wrong. If a product arrives faulty, damaged, not as described, or is not what was ordered, you make it right at your cost: replacement or refund, at the buyer's choice for major failures, including the return postage where a return is needed. You do this within five business days of the buyer's report.

Change of mind. You set your own change-of-mind policy in the portal and it is shown on your shop page. It must be at least the BamChi minimum: a buyer may return an unused item in its original condition and packaging within 14 days of delivery for a refund of the item price, with the buyer paying return postage. You may be more generous. Personalised and made-to-order items, opened food, treats and consumables, and items that touch an animal and cannot be resold for hygiene reasons (bedding, beds and grooming tools that have been used) may be excluded from change of mind, provided your listing or policy says so before purchase.

How refunds are paid. All refunds go back to the buyer's original payment method through BamChi. You do not refund a buyer directly, and you do not ask a buyer to accept a refund outside BamChi. You approve a refund in the portal; where you do not respond to a buyer's problem within two business days, or where a refund is plainly due, BamChi may approve it on your behalf and recover it under section 11.

Recalls and safety. If a product you sold is recalled, or you become aware it may be unsafe, you tell us within 24 hours, stop selling it, and cooperate with any recall, including contacting buyers through BamChi. Product safety obligations under the Australian Consumer Law, including mandatory reporting of serious injury or death associated with a product, are yours as the supplier.

13. Problems and disputes

Buyers raise problems through BamChi. You answer within two business days, in the BamChi conversation, and you keep answering until it is resolved. BamChi's support team can see the conversation and will help both sides reach the outcome the law and these terms require.

Where you and a buyer cannot agree, BamChi decides, applying these terms, your published policy and the Australian Consumer Law, and its decision about the order (refund, partial refund, return, or no refund) is final as between you and BamChi. It does not stop either you or the buyer taking the matter to a court or tribunal.

Where a buyer's card issuer reverses a payment (a chargeback), we contest it with the evidence you and we hold. If it is lost, the loss is yours where the chargeback relates to the goods, the description or the delivery, and BamChi's where it relates only to BamChi's payment systems.

Disputes between you and BamChi are first raised by email to [email protected]. We each agree to try in good faith to resolve it within 30 days before starting any proceedings, except where urgent relief is needed.

14. Talking to buyers, and their information

All contact with buyers about an order happens through BamChi, so that the record exists if something goes wrong. You may not collect a buyer's email, phone number or address for any purpose other than delivering that order, and you may not add buyers to a mailing list, message them about other products, or contact them outside BamChi unless they have separately and clearly asked you to.

Buyers' names and delivery addresses are personal information under the Privacy Act 1988 (Cth). You hold them only to fulfil the order, keep them secure, do not share them with anyone except your carrier, and delete or de-identify them when you no longer need them for the order, tax or warranty purposes. If you become aware of a data breach involving buyer information you hold, you tell us within 24 hours.

You communicate with buyers courteously. Threats, discrimination and pressure to leave or change a review are grounds for suspension.

15. Pausing, suspending and closing a shop

You can pause your shop or any listing at any time; buyers do not see paused things. You still fulfil orders already placed.

You can close your shop at any time by telling us at [email protected]. Open orders are completed, open returns are honoured, and your remaining balance is paid on the normal schedule. Your listings come down immediately.

We can suspend your shop, or particular listings, immediately and without notice where we reasonably believe you have broken section 4 (prohibited items), section 5 (listing honesty), section 14 (buyer contact and data), or the law; where a safety concern has been raised; where dispatch is repeatedly late or buyer problems are repeatedly unanswered; or where a payment or identity issue is unresolved with Stripe. We tell you what happened and what would lift the suspension. During a suspension, payouts may be held under section 11.

We can close your shop with 30 days' notice for any reason, or immediately for a serious or repeated breach. We may also close the Shop itself with 60 days' notice to all sellers. In every case you are paid what you are owed for completed orders, less anything you owe us, and sections 9 to 14, 16 and 17 continue to apply to orders already placed.

16. What you promise, and what you cover

You promise that, for as long as you sell on BamChi:

  • every product you list is yours to sell, is genuine, is safe, and complies with every law and mandatory standard that applies to it in Australia, including the Australian Consumer Law, product safety and information standards, the Therapeutic Goods Act, the Agricultural and Veterinary Chemicals Code, food labelling requirements that apply to pet food, electrical safety law and biosecurity law;
  • every listing, photo and statement you make is true and not misleading;
  • you will do everything the Australian Consumer Law requires of a supplier, including honouring the consumer guarantees;
  • you hold any licence, permit or registration your products or business require; and
  • you will not use BamChi to do anything unlawful, or to harm an animal, a buyer, or BamChi.

Indemnity. You indemnify BamChi, its directors, employees and contractors against any loss, liability, cost (including reasonable legal costs) or claim arising from a product you sold, a listing you published, your breach of these terms or of the law, or your handling of buyer information, except to the extent BamChi caused it. This includes claims by buyers, regulators and rights holders.

Insurance. We strongly recommend product liability insurance appropriate to what you sell. If you sell food, treats, supplements or anything an animal ingests, we may require proof of it before approving those listings.

17. BamChi's responsibility, and its limits

BamChi provides the marketplace: the portal, the listings, the checkout, payment collection, buyer support and marketing of the Shop to its users. We work to keep it running, accurate and secure, but we do not promise that it will be uninterrupted, error-free or that any level of sales will result. We do not inspect products, and approval of a listing is not an endorsement.

Nothing in these terms excludes any right or guarantee you have under the Australian Consumer Law that cannot be excluded. Where a guarantee cannot be excluded but liability for it can be limited, and the services are not of a kind ordinarily acquired for personal, domestic or household use, BamChi's liability is limited to supplying the services again or paying the cost of having them supplied again.

To the extent the law allows, BamChi is not liable to you for loss of profit, revenue, goodwill or business, or for indirect or consequential loss, however it arises. BamChi's total liability to you in connection with these terms in any twelve-month period is limited to the commission you paid us in that period.

BamChi is not liable for the acts of buyers, carriers, Stripe or other third parties, though we will help you deal with them.

18. Intellectual property

BamChi's name, logo, app, website, portal, designs and software are ours, and nothing here gives you any right in them except the right to use the portal to run your shop. You may say that your products are "available on BamChi" and use the BamChi name in plain text for that purpose; you may not use our logo or imply BamChi's endorsement without written permission.

You are responsible for making sure your products, names, photos and descriptions do not infringe anyone else's rights. If we receive a credible complaint, we may remove the listing while you and the complainant sort it out.

19. Reviews

When product reviews are introduced, buyers who have received an order may review it. You may respond publicly, once, courteously. You may not review your own products, arrange reviews from people who have not bought them, offer anything in exchange for a review, or ask a buyer to remove or change one. We remove reviews that break our rules, not reviews that are merely unfavourable.

20. Changes to these terms

We may change these terms. For changes to fees, section 10 applies (30 days' notice). For other material changes we give at least 14 days' notice by email to the address on your account and a notice in the portal. Changes needed to comply with the law, or that only add a new option you are free not to use, may take effect immediately. Continuing to keep your shop open after a change takes effect is acceptance of it; if you do not accept a change, you may close your shop under section 15 before it takes effect. The version date at the top of this page identifies the terms in force, and the portal records which version you accepted.

21. General

Law. These terms are governed by the law of Victoria, Australia, and you and BamChi submit to the non-exclusive jurisdiction of its courts.

Notices. Notices to you go to the email address on your seller account, and are taken to be received when sent. Notices to BamChi go to [email protected].

Relationship. You are an independent business. Nothing here makes you an employee, partner, joint venturer or franchisee of BamChi, or BamChi your agent except for the limited purpose of collecting payment and issuing receipts under sections 7 and 9.

Assignment. You may not transfer your shop or these terms to anyone else without our written consent. BamChi may transfer its rights and obligations to a related company or a buyer of its business, and will tell you if it does.

Severability. If any part of these terms cannot be enforced, the rest still applies.

No waiver. If we do not enforce a term on one occasion, we may still enforce it later.

Whole agreement. These terms, together with the BamChi Terms of use and Privacy policy and the policies you publish in the portal, are the entire agreement between you and BamChi about selling on BamChi Shop.
